The City of Thornton has adopted a City Code Declaring Abandoned Shopping Carts a Nuisance

Like many other communities within the Denver Metro Area, Thornton has experienced increased levels of visible blight. These challenges are neither unique to Thornton, nor are they short term or likely to self-resolve anytime soon. Additionally, these challenges adversely affect Thornton businesses and threaten the economic vitality of our community and the quality of life for our residents.

Shopping carts removed without authorization often end up abandoned on roadways, along sidewalks and in our creeks. Not only do abandoned carts cause blight, but it impacts businesses through the loss of their assets.

Here is What You Need to Know:

Sec. 38-455. – Shopping cart abandonment prohibited; owner responsibility; retrieval of shopping carts

  • All shopping cart owners will be required to keep shopping carts on-premises and to retrieve carts off-premises within 1 hour of closing.
  • Shopping carts left off-premises will be considered abandoned, and a city contractor will retrieve and return the shopping carts directly to the owner for a fee.
  • Business owners may also implement their own retrieval plan.
  • The proposed ordinance is not intended to fine businesses, but to require businesses to reimburse Thornton for the cost of the retrieval service on a per cart basis.
  • As a last resort, business owners that fail to reimburse the city could be subject to fines for allowing a nuisance, as well as administrative civil penalties and liens.
